What is the legislation of the Republic of Estonia?

On 15 May 2024 the Act on the Protection of Persons Who Report Work-Related Breaches of European Union Law was adopted. It is also known as the whistleblower protection act, and it requires a number of companies and public bodies to establish a confidential reporting channel.

Who does the law apply to?

  1. a legal entity with 50 or more employees;

  2. the state authority and the institution managed by it;

  3. an official body of a local government unit and an institution managed by it with 50 or more employees, or a local government unit with a population of 10,000 or more;

  4. On the subject of state financial supervision specified in § 2 subsection 2 of the Financial Supervision Authority Act.

Who should be able to report a violation?

  1. a person working on the basis of an employment contract or other contract under the law of debt;

  2. official;

  3. sole trader;

  4. member of the management and control body of a company, non-profit organization, foundation and state-owned profit-making institution;

  5. shareholder and partner of the company;

  6. a person acting as a volunteer;

  7. a person doing an internship at an institution or a legal person or a self-employed person;

  8. a person engaged in pre-contractual negotiations or otherwise preparing a contract or a person whose employment relationship has ended;

  9. a person receiving an athlete's allowance;

  10. a person working for a contractual partner of an institution or legal entity in the form specified in points 1-9 of this paragraph.
